We have drafted these Terms of Service (which we call the « Terms ») so that you have full knowledge of the rules that govern your relationship with us. We have done everything possible to avoid legal jargon, but be aware that these Terms read like a traditional contract. There is a good reason for this: these Terms are indeed a binding contract between you and Keeeds. We therefore invite you to read them carefully.
By using Keeeds, you accept these Terms. Of course, if you refuse them, you must not use Keeeds.
1. Who can use Keeeds
People aged 13 and over are permitted to create an account or use Keeeds.
2. The concept
Keeeds is an application that allows you to create daily photo albums (which we call « Daily Life »). A Daily Life creator can be shared with their loved ones (which we call Subscribers). We then distinguish two types of profiles: Creator and Subscriber (which we call « Users »).
These Users can:
– log in
– create one or more Daily Life albums
– view a Daily Life subscription
– invite loved ones to view a Daily Life
– save photos as favorites
– update their profile
– delete their account
3. Respect for others’ rights
Keeeds © respects the rights of third parties. And you must do the same. For this reason, you must not use Keeeds or allow another person to use Keeeds in a way that:
– violates or infringes the right to image, the right to privacy, copyright, trademark rights or any other intellectual property right of a third party
– threatens, harasses or intimidates
– defames
– uses spam or aims to solicit our users. You are not authorized to do the following (nor to allow someone else to do it):
– use the trademarks, logos, icons, user interface elements, designs, photographs, videos or any other material used on Keeeds
– violate or infringe on the copyright, trademark rights or any other intellectual property right of Keeeds.
– copy, archive, download, upload, distribute, publish, broadcast, perform, display, make available or otherwise use any part of Keeeds
– use Keeeds for commercial purposes without our consent. In summary: you cannot use Keeeds or the content on Keeeds in any way other than as authorized by these Terms. You also cannot help someone else do so.
4. Privacy
Data protection
All data you provide to us is used to enable us to create your Daily Life, photo albums and profile. Under the law of January 6, 1978 on data protection, you have the right to rectification, consultation, modification and deletion of the data you have provided to us. This right can also be exercised online.
Use of personal data collected
We receive your information to enable the creation of your Daily Life as well as your photo album orders and to optimize your browsing on Keeeds. Some information is mandatory to properly use the application. The mandatory nature of these elements is indicated in the forms by an asterisk or by a mention « required ». The personal data collected is your first name, email address, the first name of the children for whom you wish to create a Daily Life as well as their date of birth. This data is retained for the entire life of the application. Data is transmitted to our platform securely through https encryption. We work with various companies that allow us to provide our service (web host, email sending, among others) who may receive, host and process this data. Depending on their sensitivity, different procedures such as encryption can be applied to the data to protect it so that it is not accessible or readable. This privacy policy may change. Any reduction in your rights under this policy cannot be applied without your express consent. Any changes to the privacy rules will be indicated on this page and in the case of significant modifications, we will publish a warning and may notify you by email if necessary.
5. Your rights
The application we provide you can download and automatically install updates, or other new features. You can adjust and control these automatic downloads in your device settings. You may not copy, modify, distribute, sell or rent any or all of our Keeeds, nor perform reverse engineering or attempt to extract source code from software, unless the laws prohibit these restrictions or we have given you our written permission.
Rights you have over your data
You can request to receive a file containing all personal data we have about you, including data you have provided to us. You can also request the deletion of your personal data.
6. Our rights
Keeeds allows you to create, upload, publish, send, receive and store content for which you are solely responsible. When you do so, you retain all ownership rights to that content. However, you grant us a license to use this content. For the proper management of the site, the publisher of Keeeds may at any time:
– suspend, interrupt or limit access to all or part of the site, restrict access to the site, or certain parts of the site, to a specific category of users
– remove any information that could disrupt its operation or violate national or international laws
– suspend the site in order to perform updates.
7. Third-party content
A large part of the content on Keeeds is produced by Users. This content, although submitted privately, remains the sole responsibility of the person or organization that submitted it. We reserve the right to examine or remove all content present on Keeeds, we do not systematically verify all this content. For this reason, we cannot take responsibility – and do not take – for content provided by others via Keeeds.
8. Modifications
We are constantly improving Keeeds. This means we may add or remove features, functionalities or products and we may also temporarily or permanently suspend the Keeeds application.
The publisher of Keeeds implements the technical solutions at its disposal to allow access to the site 24 hours a day, 7 days a week. However, it may at any time suspend, limit or interrupt access to the site or certain pages of it in order to perform updates, modify its content or perform any other action deemed necessary for the proper functioning of the site. We can take these measures at any time and without notifying you in advance.
9. Termination
We hope you will always use Keeeds. You can, however, terminate these Terms at any time and for any reason by deleting your account. Keeeds © may also terminate these Terms with you at any time, for any reason and without notice. In other words, we can stop providing you with Keeeds.
